Rules and Regulations

 

1. General

This songwriting contest is open to anyone: amateur or professional songwriters and/or musicians, from anywhere in the world, excluding close relatives and partners of the organizers of the 100% Music Songwriting Contest. Under-18s may enter and entrants may be a representative of the band(s)/artist(s). Songs must be original. Entrants will retain full rights to all work submitted for the contest. The contest is open from March 30, 2009 to September 28, 2009 and is organized by the company 100% Music Songwriting Contest, listed on the company register under SIREN number 500 050 075, address: 100% Music Songwriting Contest – 6 rue Joubert BP 55116 – 49051 ANGERS CEDEX 2 - FRANCE.


2. Entry Information

a) Categories, winner selection and judging criteria
The contest has 9 categories. 8 are judged on composition and melody: Acoustic, Pop/AC, Rock, Electronic, Blues/Jazz, Soundtracks/TV/Video games, World, Hip Hop/R&B. Entries for the 'Best Lyrics' category are judged on lyrics composition, overall composition and melody. For this category, lyrics sheets are required. If the song is in a language other than English or French, an English or French translation must be provided. For all categories, the quality of recordings is not a submission requirement and entries will not be judged on the strength of recording quality. Songs may be in any language.


Classification, judging and ranking in every category will be carried out as follows: 1-3: Winners 4-10: Finalists 11-15: Semi-finalists 16-20: Honor Awards. Each first category winner will be judged and ranked as follows: 1-3: Overall Winners. Honor awards, semi-finalists and finalists in each category will be chosen by the 100% Music Songwriting Contest. Winners in each category and overall winners will be chosen by an independent panel of judges composed of music industry professionals.

b) Entry fees
Entry fees are $15 (US) per entry. Several songs can participate in the same category (for example 3 songs entered in the Blues/Jazz category would count as 3 entries and would cost 45US$). A song can participate in several categories (for example, a song 'A' could for example participate in 2 categories, Acoustic and Best lyrics (and music), that would count as 2 entries and would cose 30US$) The number of songs that can be submitted is illimited. Entry fees are non-refundable.

c) Postal entries
If contestants enter the contest by mail, they must include in their submitted material:

- Audio CD(s), data CD(s)  and/or data DVD(s) containing the songs.
- A completed entry form(s), copy, or photocopy.
- A lyrics sheet is not needed for all categories EXCEPT for the 'Best Lyrics' category, where it is required, with an English or French translation if the text is in another language.

The entry fee may be paid by credit card. Charging to a credit card requires the completion of the charge authorization fields on the submission form which provide information about the card and cardholder. The Cardholder authorizes the 100% Music Songwriting Contest to charge his/her card with the amount he/she has specified on the submission form, depending on the number of entries he/she submits to the contest.

d) Online entries
To enter using the contest website, entrants may use the online entry form and follow the instructions. Contestants may also submit their songs online through Sonicbids. If they are not yet a Sonicbids member and want to submit online, they should visit http://www.sonicbids.com/100musicsongwritingcontest and sign-up for the Sonicbids Combo Package (includes submission AND discounted Sonicbids membership). If they are already a Sonicbids member, they may log in to their Sonicbids account and visit the Promoter Drop Box to submit an entry.

 

3- Prizes

Overall winner will receive: $2,500 (US) cash, a Tascam DP-02 digital recorder (value: $799), a Total Workstation bundle from IK Multimedia (value: $699.99), a Roland E-09 keyboard (value: $629), a licence for the Blue Cat’s Master Pack plugin bundle (value: $399), 1 year artist membership on MusicGorilla.com (value: $229.95), a copy of EarMaster Pro 5.0 software (value: $116), a licence for the The Flutes pack plugin bundle from Kong Audio (value: $115), a 1-year artist retail account on uaRadio.net (value: $99), a product of his/her choice from Equinox sound's product range (value: $22 to $89), a licence for the Guitar Pro 5 software (value: $87), a product of his/her choice from Producer Loops product range. (value: 16,55 € to 33,16 €)

2nd Overall winner will receive: a Total Workstation bundle from IK Multimedia (value: $699.99), a licence for the Blue Cat’s Analysis Pack plugin bundle (value: $254.15), a Boss DR-3 Dr. Rhythm Drum Machine (value: $269.50), a licence for the The Bowed Strings pack plugin bundle from Kong Audio (value: $115), a copy of EarMaster Pro 5.0 software (value: $116), a copy of Guitar Pro 5 software (value: $87)

3rd Overall winner will receive: a Total Workstation bundle from IK Multimedia (value: $699.99), a licence for the Blue Cat’s Multi Pack plugin bundle (value: $199), a copy of EarMaster Pro 5.0 software (value: $116), a licence for the The Plucked Strings pack plugin bundle from IK Multimedia (value: $108)

First category winners will receive the following: a license for My Music Shop (value: 249 €), 1 Sennheiser e825S microphone (value: $114), a license for EarMaster Pro Essentials software (value: 29.95 €), 10 plectrums featuring the contest logo, a three month rotation on the contest website home page with photo, name and winning song title, inclusion in a promotional CD along with an artist presentation pack including their contact information. 400 copies of this CD will be made. The CD will be for promotional purposes only and may not be sold. To be included, songs must be free of copyright. If not, winners will receive the other prizes from their prize list but an alternative winner in their category will be chosen to be included in the compilation.


Second winner in each category will receive: 1 Sennheiser e825S microphone (value: $114), 1 set of Sennheiser eH 150 headphones (value: $69.95), 10 plectrums featuring the contest logo.

Third winner in each category will receive: 1 set of Sennheiser eH 150 headphones (value: $69.95) , 10 plectrums featuring the contest logo.

The 100% Music Songwriting Contest will incur the cost of shipping prizes where required, but will not be responsible for any delay, damage or non-delivery of prizes delivered via postal services. CDs and lyrics will not be returned. The prizes will be sent within a reasonable time after the results have been determined and the winners notified. The 100% Music Songwriting Contest cannot be held responsible for any delivery delays or difficulties caused by circumstances that are beyond their control. Notably, the 100% Music Songwriting Contest cannot be held responsible for any losses or damages due to postal services or other carriers, including non-delivery of prizes. The 100% Music Songwriting Contest is not responsible for any circumstances or damages arising from the use of prizes that are given to the winners. In the event that a winner chooses not to accept a prize, the winner forfeits all future claims to that prize. Prizes will be awarded jointly to all performers and songwriters. Distribution of awarded prizes is the responsibility of winners. The winners release sponsors from all liability regarding prizes won. Taxes on prizes are the responsibility of the winners.

 

4. Results and winners notification

Honor awards, semi-finalists and finalists from each category will be announced on 24 October, 2009. Winners and overall winners will be announced on 30 November, 2009. Winners will be notified by email to the email address they provided, or by phone, and must sign and return an affidavit confirming that the winner’s song is original and he/she holds any rights to the song, within ten (10) days following this notification date. The affidavit will state that the winner(s) hold all copyrights for the music submitted and that their winning song is their own original work. Failure to sign and return this affidavit within ten (10) days, or the provision of false/inaccurate information therein, will result in immediate disqualification and an alternative winner will be selected. Affidavits signed by winners under eighteen (18) years old must be countersigned by the winner’s parent or legal guardian. Affidavits will be verified by 100% Music Songwriting Contest. Winners authorize 100% Music Songwriting Contest to use their names, likeness and voices for future contest publicity and advertising purposes without additional compensation. Winners’ names, likenesses and voices will not be used outside the contest. The list of winners will be displayed on this website.

 

5. Organizers' decisions

The 100% Music Songwriting Contest reserves the right to modify the rules and regulations at any time and to take all decisions that it believes to be useful for the application and interpretation of the rules and regulations. The 100% Music Songwriting Contest will contact the participant by whatever means it chooses. The 100% Music Songwriting Contest also reserves the right to modify, extend, cut short, suspend or cancel the contest, without notice, in the light of any circumstances beyond its control. In particular, the 100% Music Songwriting Contest reserves the right to invalidate and/or cancel all or part of the contest in the case of fraud or technical failure, notably that involving data handling or selection of winners. In that case, the 100% Music Songwriting Contest gives itself the right to refer anyone committing fraud to law enforcement organizations. Any participant who commits fraud will automatically be disqualified. The 100% Music Songwriting Contest may not be held responsible for delays or cancellation caused by any of the reasons stated above and participants will not be entitled to a refund in these cases.

 

6. Rules and regulations submission

These rules and regulations have been submitted to 'SCP Montel-Simeone-Segura-Simeone, huissiers de justice associés, 21 rue Bonnefoy, 13 006 Marseille, France'. 7. Responsibility

Entrants to this contest acknowledge the features and the limitations of the Internet, notably in regards to technical performance, response times for website access, risks of interruption, risks linked to connection, risks of information theft, and risks posed by malicious software released on the Internet. The 100% Music Songwriting Contest cannot be held responsible for such risks. The 100% Music Songwriting Contest cannot guarantee that the website and/or the contest will run without interruption, that they do not contain any errors in information technology, or that any errors will be corrected. The 100% Music Songwriting Contest cannot be held responsible for any technical malfunctions during the contest, for any difficulty in connecting to the contest website or accessing it, for non-delivery of entry data to the 100% Music Songwriting Contest for any reasons beyond the contest organizers’ control (for example, a user’s own internet connection problem), for any problems due to corrupted files or non-compliant file formats, or in case of problems with e-mail transmissions. The participants are not eligible for any refund under these circumstances. The 100% Music Songwriting Contest cannot be held responsible for any damage, material or immaterial, caused to the participants, their computer equipment and the data that are stored inside, or for any consequences, direct or indirect that may arise as a result, notably in their personal, professional or commercial activity.

 

8. Personal data

As stated above, to enter the contest, participants must give certain personal information (such as first name, last name...) This information will be saved in a data file as it is necessary to take account of their participation, to determine the winners, and to send out prizes. In accordance with French law “loi n° 78-17 du 6 janvier 1978”  in relation to data, files and free access, participants may be able to modify or erase their personal information. To do that, participants must send a letter to: 100% Music Songwriting Contest – 6 rue Joubert BP 55116 – 49051 ANGERS CEDEX 2 - FRANCE. By entering this contest, participants will be able to subscribe to a newsletter. If they subscribe to this electronic newsletter, every e-mail sent to the participant will provide them with the opportunity to cancel their subscription at any time.

 

9. Applicable law, differences

The rules and regulations governing this contest are laid out under French law. This translation into English of the 100% Music Songwriting Contest Rules and Regulations is provided for your convenience only. In case of any dispute, this contest will be regulated only by the rules and regulations as given in the original French version, and in accordance with the laws of France. To be considered, notice of any dispute or claim must be sent to: 100% Music Songwriting Contest – 6 rue Joubert BP 55116 – 49051 ANGERS CEDEX 2 - FRANCE no later than ninety (90) days after the end of the contest. If a disagreement concerning the application and interpretation of these rules and regulations cannot be resolved, all litigations must be sent to the Court of Justice of ANGERS (49, FRANCE) to which all competences are attributed.
